Article 1 – Definitions

For the purposes of these terms and conditions, the following terms shall have the meanings as set forth below:

• Reflection Period: The period during which the consumer may exercise the right of withdrawal.
• Consumer: The natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur.
• Day: Calendar day.
• Ongoing Transaction: A distance contract relating to a series of products and/or services where the obligation to deliver and/or purchase is spread over time.
• Durable Medium: Any tool enabling the consumer or entrepreneur to store information addressed personally in a way that makes future consultation and unchanged reproduction possible.
• Right of Withdrawal: The consumer’s option to withdraw from the distance contract within the reflection period.
• Model Withdrawal Form: The standard form provided by the entrepreneur for exercising the right of withdrawal.
• Entrepreneur: Beautiefy B.V., the legal entity offering products and/or services at a distance to consumers.
• Distance Contract: An agreement concluded under an organized system for selling products and/or services at a distance, using one or more means of distance communication until the moment the contract is concluded.
• Means of Distance Communication: Tools that may be used to conclude a contract without the consumer and entrepreneur being together in the same location.
• General Terms and Conditions: These terms and conditions.

Article 3 – Applicability

These general terms and conditions apply to all offers by Beautiefy B.V. and to every distance contract concluded between Beautiefy B.V. and the consumer.

Before concluding the distance contract, the text of these terms will be made available to the consumer. If this is not reasonably possible, Beautiefy B.V. will indicate how the terms can be reviewed electronically and will send them free of charge upon request.

If the contract is concluded electronically, the text of these terms may be provided in a digital format that the consumer can easily save and consult later. In case of additional specific product or service terms, these will also be provided, and in the event of conflicting terms, the consumer may rely on the most favorable provision.

If a provision of these terms is declared null and void or annulled, the remaining provisions remain valid, and the invalid clause shall be replaced by a lawful provision that most closely matches the original intent.

Any ambiguities in interpreting these terms shall be clarified ‘in the spirit’ of these provisions.

Article 4 – The Offer

• The offer clearly states whether it is subject to conditions or has limited validity.
• The offer is non-binding; Beautiefy B.V. may revise or withdraw the offer.
• The offer provides an accurate and complete description of products/services to enable a proper evaluation by the consumer. Images and specifications are indicative; minor deviations shall not result in liability.
• All prices include VAT. Any shipping costs and applicable charges are specified.
• Key details of the offer include:
  • Payment and delivery methods
  • Applicability of the right of withdrawal
  • Duration of the offer and price validity
  • Steps needed to conclude the contract
  • Whether the contract will be archived and how the consumer can access it
  • Available languages
  • Relevant codes of conduct
  • Minimum duration in the case of ongoing transactions

Article 5 – The Agreement

The agreement is established when the consumer accepts the offer and meets the relevant conditions.

When acceptance occurs electronically, Beautiefy B.V. promptly confirms receipt. The consumer may dissolve the agreement until confirmation is received.

Beautiefy B.V. implements technical and organizational measures to secure electronic transactions and ensures a safe web environment.

Beautiefy B.V. may, within legal limits, verify whether the consumer can meet payment obligations and assess other relevant factors. If there are legitimate reasons, Beautiefy B.V. may refuse or set special conditions for an order.

With delivery, Beautiefy B.V. provides:

• Business address for complaints
• Information on the right of withdrawal or its exclusion
• Warranty and after-sales service details
• Information required by Article 4
• Conditions for termination if the contract exceeds one year or is indefinite

All contracts are subject to the availability of the ordered products.

Article 6 – Right of Withdrawal

For products:

• The consumer has 14 days from receipt to withdraw without giving reasons.
• During this period, the consumer must handle products carefully and only use them as needed to assess suitability.
• Products must be returned in original condition and packaging if reasonably possible. Return costs are borne by the consumer.
• The consumer must notify Beautiefy B.V. of withdrawal within 14 days of receipt, using the model form or other written means, and return the product within another 14 days.

For services:

• The consumer may withdraw within 14 days from contract conclusion.
• Beautiefy B.V. provides clear instructions on how to exercise this right.

Article 7 – Costs in Case of Withdrawal

• Only the direct return shipping costs are borne by the consumer.
• If the consumer has paid, Beautiefy B.V. refunds the amount within 14 days of receiving the returned goods or proof of return.
• Refunds use the same payment method unless agreed otherwise.
• The consumer is liable for any diminished value resulting from use beyond what is necessary to establish the nature and characteristics of the product.
• If Beautiefy B.V. did not provide required information on the right of withdrawal, the consumer is not liable for depreciation.

Article 8 – Exclusion of Right of Withdrawal

Exclusion is possible if stated clearly before concluding the contract, for:

• Products made to consumer specifications or of personal nature
• Products that cannot be returned due to their nature, perish quickly, or whose seal is broken (e.g., hygiene products, audio/video, software)
• Newspapers and magazines
• Services involving accommodation, transport, catering, leisure for a specific date, or which have already started with consumer consent

Article 9 – Prices

• Prices will not increase during the offer validity except for VAT adjustments.
• Prices may vary if subject to financial market fluctuations; this is clearly stated in the offer.
• Price increases within three months are allowed only if legally mandated.
• Price increases after three months require consumer consent or give the right to cancel.
• All prices include VAT. Beautiefy B.V. is not liable for obvious misprints.

Article 10 – Conformity and Warranty

Products and services comply with the contract, offer specifications, legal standards, and reasonable usability.
Beautiefy B.V. honors manufacturer warranties. Warranty claims must be reported within two months of discovery.

Warranty does not apply if:

• Products were altered or repaired by third parties
• Products were misused or exposed to abnormal conditions
• Damage results from government regulations regarding materials

Article 11 – Delivery and Execution

Beautiefy B.V. handles orders with care. Delivery occurs to the address provided.

Orders are delivered within 30 days unless otherwise agreed. If delayed, the consumer may cancel without cost.

All delivery times are indicative. Beautiefy B.V. is not liable for delays.

If unavailable, Beautiefy B.V. may offer a replacement, which the consumer may refuse. Return shipping costs for replacements are borne by Beautiefy B.V.

Risk of damage or loss transfers to the consumer upon delivery.

Article 12 – Duration, Termination, and Renewal

• Consumers may terminate indefinite contracts with up to one month’s notice.
• Fixed-term contracts may be terminated at the end of the term with up to one month’s notice.
• Tacit renewal is generally not permitted except for daily or weekly publications under certain conditions.
• After one year, consumers may terminate contracts with a maximum notice period of one month.

Article 13 – Payment

Payments must be made within 7 working days unless otherwise agreed.

The consumer must report inaccuracies immediately.

If payment is overdue, Beautiefy B.V. may charge reasonable costs as communicated in advance.

Article 14 – Complaints Procedure

Beautiefy B.V. has a clear complaints process.

Complaints must be reported within two months of discovery. They will be answered within 14 days. If longer investigation is needed, consumers will be informed.

If unresolved, consumers can contact WebwinkelKeur for mediation or file via the European ODR platform. Decisions from appointed dispute committees are binding.

Complaints do not suspend payment obligations.

If a complaint is valid, Beautiefy B.V. may replace or repair products.

Article 15 – Disputes

All contracts are governed exclusively by Dutch law. The Vienna Sales Convention does not apply.

Article 16 – Additional or Deviating Provisions

Any additional provisions shall not disadvantage the consumer and must be documented so they can be stored and accessed by the consumer.

Article 17 – Authenticity and Brand Authorization

Beautiefy B.V. is a certified reseller of all the brands available in its online store. All products are 100% original and sourced directly from certified wholesalers within Europe. We guarantee that every item sold is authentic and meets the quality standards established by the original manufacturers.
